These Terms and Conditions (“Terms”) are an agreement between you and Next Level Fintech Services LLC (“Next Level Fintech Services,” “we,” “our,” or “us”) governing your use of nextlevelinfintech.com (the “Site”), our free tools, and any products or services you purchase from us.

By accessing the Site or purchasing from us, you agree to be bound by these Terms. Please read them carefully. If you do not agree, do not use the Site.

1. Who We Are and What We Do

Next Level Fintech Services LLC is a limited liability company located at 418 Broadway STE N, Albany, NY 12207, United States.

We provide financial education, budgeting spreadsheets, and coaching focused on organizing income and expenses, forecasting cash flow, planning debt payoff, and building savings.

We are not a registered investment advisor, broker-dealer, accountant, tax preparer, attorney, credit repair organization, or debt settlement company. Nothing we publish, sell, or say in a coaching session is investment, tax, legal, or accounting advice. We do not recommend specific securities or investments, we do not negotiate with your creditors, and we do not take custody of or manage your money.

2. Eligibility and Communications

  • Age: You must be at least 18 years old and able to enter a binding contract to purchase from us or book a coaching session.
  • Accurate Information: You agree to provide accurate billing and contact information.
  • Transactional Email: When you buy from us we will email you order confirmations, download links, and activation keys. These are not marketing messages and you cannot opt out of them while your order is active.
  • Marketing Email: We will only send newsletters and product updates if you ask to receive them, and every one contains an unsubscribe link.

3. Overview and Digital Delivery

  • Product Description: We sell specialized digital personal budget spreadsheets and related coaching services.
  • Instant Delivery: Products are delivered electronically via download link or email after payment.
  • No Physical Goods: No physical items will be shipped to you.
  • Pricing: All prices are in US dollars and may change at any time. The price shown at checkout is the price you pay.
  • Order Acceptance: Your order is accepted when we send confirmation and provide access to the download. We may cancel or refuse an order where we suspect fraud, a pricing error, or a breach of these Terms.
  • Payment: Payments are handled by third-party processors. We do not receive or store your full card details.

4. Using the Site and Our Free Tools

These Terms apply to everyone who uses the Site, whether or not you buy anything.

Our free tools, including the Debt-Free Date Calculator, are provided as-is and for educational purposes only. They perform arithmetic on figures you enter and return estimates. Those estimates assume fixed interest rates, fixed payments, and no additional borrowing, and they do not account for fees, rate changes, missed payments, promotional periods, taxes, or your individual circumstances.

Results are planning estimates, not predictions, guarantees, or advice. You are responsible for verifying any figure before acting on it, and for any decision you make.

You agree not to:

  • Copy, resell, redistribute, or republish our tools, spreadsheets, or written content
  • Use automated systems to scrape, overload, or disrupt the Site
  • Use the Site for any unlawful purpose or to infringe anyone’s rights
  • Present our materials as your own, or remove our branding from them

5. Software Requirements and Technical Limits

Read this section before you buy. It describes what you need in order to use our spreadsheet products at all.

  • Microsoft Excel Exclusive: Our spreadsheets are designed, built, and optimized strictly for Microsoft Excel on the Windows desktop application, Microsoft 365 or Excel 2021 and later.
  • Compatibility: They will not function correctly on Google Sheets, Apple Numbers, LibreOffice, OpenOffice, or other alternative spreadsheet software.
  • Not for Mac, web, or mobile: They are not compatible with Excel for Mac, Excel for the web, or the Excel mobile apps. Some features rely on functions and behavior present only in the Windows desktop version.
  • User Responsibility: You are solely responsible for ensuring you have a compatible, active version of Microsoft Excel installed on your device prior to purchase. An Excel licence is not included in the purchase price.

If you are unsure whether your setup qualifies, email us before you buy and we will tell you.

6. XLS Padlock Licensing and Hardware Locking

  • Security Protection: Our files are compiled and protected using XLS Padlock to prevent piracy and protect our proprietary formulas and code.
  • Activation Keys: Each purchase grants you a single, unique activation key.
  • Hardware Binding: The activation key is hardware-locked to your specific computer system. It cannot be used on multiple devices simultaneously.
  • No Key Sharing: Sharing your activation key or bypass codes with third parties will result in immediate and permanent revocation of your licence without a refund.
  • Hardware Changes: If you replace or substantially change your computer, contact us at support@nextlevelinfintech.com and we will reissue your key where the original licence is in good standing.

7. Intellectual Property and Permitted Use

  • Single-User Licence: Your purchase grants you a non-exclusive, non-transferable licence for your personal use only, or the use of your own single business.
  • Prohibited Actions: You may not copy, reverse-engineer, decompile, crack, or attempt to bypass the XLS Padlock security layers.
  • No Commercialization: You may not resell, redistribute, or use these templates to provide paid financial services to others.
  • No Sharing: You may not share, sublicense, lend, rent, or give the file to anyone else, or post it to a file-sharing service, public drive, forum, or website.
  • Ownership: We retain all intellectual property rights in our spreadsheets, tools, written content, and branding. Buying a product does not transfer ownership of it.

We may revoke a licence, without refund, if you breach this section.

8. Refund and Cancellation Policy

  • All Sales Final: Due to the digital nature of our products and instant key generation, all sales are final. We do not offer refunds, exchanges, or cancellations once files or activation keys have been issued, except as set out below.
  • Compatibility Exception: If the file will not run on a system that meets the requirements in Section 5, contact us within 14 days of purchase and we will either resolve the problem or refund you in full.
  • Technical Exceptions: If you experience an activation failure or receive a corrupted file, contact us immediately and we will provide technical support or a replacement key.
  • Duplicate or Failed Orders: We refund duplicate charges, and orders where delivery failed and we could not resolve it.
  • How to Request: Email support@nextlevelinfintech.com with your order number and a description of the problem.

9. Coaching Sessions

  • Coaching covers budgeting mechanics, cash flow organization, debt payoff planning, and setting up our tools. It does not include investment recommendations, advice on specific securities, tax preparation, legal advice, or creditor negotiation on your behalf.
  • Sessions are delivered remotely unless agreed otherwise, and are scheduled after purchase.
  • Please give at least 24 hours’ notice to reschedule. Sessions missed without notice may be treated as delivered.
  • Anything you share in a session is treated confidentially, subject to our Privacy Policy and any legal obligation to disclose.
  • You remain solely responsible for the financial decisions you make.

10. No Guarantee of Results

We make no promise about any financial outcome. Any figure, timeline, example, or result shown on the Site, in our materials, or in a coaching session is illustrative only. Your results depend on your income, expenses, interest rates, discipline, and circumstances entirely outside our control.

11. Accounts

If you create an account, you are responsible for keeping your password confidential and for everything that happens under your account. Provide accurate information and tell us promptly if you believe your account has been accessed without permission. We may suspend or close an account that breaches these Terms.

12. Third-Party Links and Services

The Site links to and relies on third-party services, including payment processors, our email provider, and analytics providers. We do not control them and are not responsible for their content, practices, or availability. Their terms and privacy policies apply to your use of them.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site, our free tools, and our products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that our calculations will be free from error.

14. Limitation of Liability

To the fullest extent permitted by law, Next Level Fintech Services LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost savings, lost data, or financial loss arising from your use of the Site, our tools, our products, or our coaching — even if we have been advised of the possibility of such damages.

Where liability cannot be excluded, our total aggregate liability to you is limited to the amount you paid us in the twelve months before the claim arose, or one hundred US dollars, whichever is greater.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

15. Indemnity

You agree to indemnify and hold harmless Next Level Fintech Services LLC from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your breach of these Terms, your misuse of the Site or our products, or your violation of any law or third-party right.

16. Changes to These Terms

We may update these Terms at any time. The revised version takes effect when posted, with an updated “Last Updated” date. Your continued use of the Site after a change means you accept it. Purchases are governed by the Terms in effect on the date of your order.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Albany County, New York, and you consent to their jurisdiction.

18. Suspension and Termination

We may suspend or terminate your access to the Site, your account, or your product licence, without refund, if you breach these Terms — in particular the licensing restrictions in Sections 6 and 7. You may stop using the Site at any time. Sections 7, 10, 13, 14, 15 and 17 survive termination.

19. General

  • If any provision of these Terms is held unenforceable, the rest remain in force.
  • Our failure to enforce a provision is not a waiver of it.
  • These Terms, together with our Privacy Policy, are the entire agreement between us and supersede any earlier version.
  • You may not assign these Terms; we may assign them in connection with a sale of the business.
